David Duchovny is not giving new meaning to the tennis term love.

A rumor circulated this weekend that the Californication star was having an affair with Edit Pakay, his 28-year-old Hungarian-born tennis instructor. But Pakay tells E! News that's simply not the case.

"Yeah, we played tennis and we were playing partners and friends," she says. "There is no romance, and we are just friends. No love, nothing. That is all I have to say."

Pakay's insistence that there is "no romance" between her and the former X-Files actor, who recently split from wife Téa Leoni, comes after a report in London's Mail on Sunday linking the two of them together. Pakay allegedly told the paper: "I don't want to say anything that might hurt David. I am not going to deny it. I don't know what our relationship means to him."

But David Duchovny’s lawyer, Stanton “Larry” Stein, tells E! News exclusively  that he spoke with Pakay before and after the Daily Mail’s alleged affair story came out, and Pakay told him, “it is all lies and deceit.”

“Edit Pakay met with me personally before this article came out and told me she never had a sexual or romantic relationship with David,” says Stein.

Stein says a woman from the Daily Mail named Caroline Graham contacted him before the story ran Sunday and asked for his comment. “I advised her that it was false and not to run with it, and she went ahead with it anyway,” says Stein.

The lawyer claims they're planning on filing a suit against the tab for the story about the affair.

Stein also told E! News Monday afternoon that Pakay has signed a declaration under penalty of perjury in which she states that she does "not have romantic feelings toward him and, based on our interactions, I believe that David Duchovny does not have romantic feelings toward me.

"The last time that I met up with David Duchovny was almost a year ago, in November 2007, when we made plans to play tennis. His personal trainer was also with us. Since November 2007, I have not seen David Duchovny, other than running into him briefly at the gym in March 2008 where he was working out."

E! News also spoke with former tennis pro Trey Waltke, who works at the Malibu Racquet Club, where Duchovny, a longtime Malibu, Calif., resident, regularly plays. Waltke says he doesn't know anything about an affair.

"I've only worked there about a year, and I've never met her," says Waltke. "She doesn't work there anymore and hasn't for at least a year."
