Clark County Detention CenterErin Brokovich-Ellis caused quite the disturbance before being arrested for alleged DUI behind the wheel of a boat, according to the Nevada Department of Wild Life official who questioned her sobriety at the scene.
In a 16-page boating crime report released today, Game Warden Kasen Haslem states that, on June 7, a marina employee alerted him to an argument taking place aboard a parked vessel at the Las Vegas Boat Harbor, telling him that "both individuals appeared to have been drinking heavily during the day."
Haslem stated in the report, obtained by E! News, that he then witnessed the woman later identified as Brockovich-Ellis throw a cell phone into the lake and "then approached her husband and it appeared that she slapped him."
"After this they both appeared to sit down and cease arguing," Haslem recalled.
Also today, the Clark County District Attorney's Office filed a criminal complaint charging the famed former legal assistant with one misdemeanor count of operating a boat while intoxicated. A hearing is scheduled for Oct. 7 in Henderson Justice Court.
As a first-time offender in the state of Nevada, Brockovich-Ellis is facing a maximum sentence of six months in jail, a $1,000 fine, 96 hours of community service and court-ordered alcohol/drug counseling.
Meanwhile, in the arrest report, Haslem recalls approaching Brockovich-Ellis as she was about to pull the boat out of the slip, her husband no longer in sight. He states that she told him she wasn't very good at operating her vessel and she couldn't get it to move forward.
Haslem stated that he began questioning her about the argument he had just witnessed and that she "was slurring her words, and she kept repeating what she was saying, and [he] detected the odor of an alcoholic beverage on her breath."
She also avoided answering his questions and started talking about her kids and recent plastic surgery she had undergone instead, Haslem's statement continued. Asked if she had been drinking during the day, Brockovich-Ellis admitted that she had, but only two drinks and nothing in the past four hours.
Brockovich-Ellis issued an apology for her behavior on Sunday, stating that while she did not believe that she had created a public safety risk because she was not operating the boat in open water, "I take drunk driving very seriously, this was clearly a big mistake, I know better and I am very sorry."
